Shopify owes $40 million to patent holder Express Mobile Inc said Delaware jury in a verdict. The e-commerce giant has been held responsible for infringing three patents related to mobile-website technology. Express Mobile was awarded a lump sum on Wednesday. Federal jury also rejected Shopify’s arguments stating that the patents are not valid.
In response to the verdict, Shopify spokesperson on Thursday said that the company was “disappointed and surprised” but is confident that Shopify does not infringe and “intends to pursue the matter in the district court or, if necessary, on appeal.”
Express Mobile attorney Jay Nuttall of Steptoe & Johnson said that the verdict showed that the company’s technology is “an important and valuable improvement that was being used by Shopify”.

Developed by the company’s founder, Steven Rempell Express Mobile owns patents related to mobile technology and internet. Rempell is also a former IBM engineer. Mobile Express argued that website-building tools of Shopify infringed its patents related to software providing mobile content.
Express Mobile has cases going against Meta, Google and Amazon. It has sued dozens of tech companies accusing them of infringing patents. After Shopify asked the Delaware Court for a declaration stating that it did not infringe any patents, Express Mobile sued the e-commerce giant in 2019.
